CERTIFICATE OF WARRANTY / GUARANTEE

 

EFFECTIVE DATE:  DATE OF BENEFICIAL OCCUPANCY

Imperial Fastener Co., Inc. warrants its Cubicle Tracks, Cubicle Curtains, I.V. Tracks, Shower Curtains and Hardware to be free from defects in materials and workmanship to the following extent: In the event defects in workmanship or materials are reported to Imperial Fastener Co., Inc. within one year of date of Beneficial Occupancy, the Company will repair or replace, at its option, such defects or products to eliminate the defect.

THERE ARE NO OTHER WARRANTIES, EXCEPT AS EXPRESSLY SET FORTH ABOVE, EITHER EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. The Company's liability with respect to its installation shall not exceed that expressly set forth above, irrespective of the theory upon which any claim might be based, including breach of contract, warranty, negligence or strict liability in tort, and under no circumstance shall the company be liable for incidental or consequential damages.
